3. 甲方应确保出租的房屋享有出租的权利，反之如乙方权益因此遭受损害，甲方应负赔偿责任。

七、 乙方义务 obligations of party b
1. 乙方应按合同的规定按时支付定金、租金及保证金。

八、 合同终止及解除的规定 termination and dissolution of the contract

八、甲方的责任：
party a‘s obligations：
8.1 甲方须按时将出租房屋及其家私家具用品与其设施以良好状态交付乙方使用。
party a shall deliver on schedule to party bvacant possession of the leased property including the furniture，furnishing and appliances and the related facilities for party b‘s use（furniture，furnishing and appliances to be detailed in appendisl.）
8.2 租赁期内甲方不得收回出租房屋（除非本合同另有规定），甲方保证乙方可不受干扰的享用该物业。
party a shall not repossess the leased property during the term of party a disturb of interfere with party b‘s quiet enjoyment of the leased property.
8.3 在乙方遵守本合同的条款及支付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

8.4 租赁期内出租房屋的结构，进出物业的排水、上下管道、电路等处于良好使用状态。

九、乙方的责任：
party b‘s obligations：
9.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。
party b shall promptly pay all rent ，security deposit and other charges payable by it in accordance with the terms of this agreement.
9.2 乙方应爱护使用出租房屋，如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏（正常损耗除外），乙方应负赔偿责任。
paryt b shall treat the leased property with care. if as a result of party b‘s negligence or misconduct， the leased property and the related facilities and accessorties suffer any damage（fair wear and tear excepted ），party b shall be responsible for compensating party a for such damages.
9.3 乙方应按本合同的约定合法使用出租房屋，不得擅自改变使用性质，不应存放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。

9.4 未经甲方事先书面同意，乙方不得将出租房屋转租或租给其他的第三者。

十、违约处理：
breach of agreement ：
10.1 甲、乙任何一方如未按本合同的条款履行，构成违约，应承担相应的违约责任。双方同意违约方应赔偿守约方之直接损失人民币____________元。

凡因执行本合同所产生的或与本合同有关的一切争议，双方应通过友好协商解决；协商不成，应提交中国国际经济贸易仲裁委员会，按其仲裁规则和中华人民共和国仲裁法进行仲裁。仲裁解决是终局的，对双方都有约束力。

五、 保证金 deposit
1. 为确保房屋及其附属设施之安全与完好，及租赁期内相关费用之如期结算，乙方同意于______年_____月_____日前支付给甲方保证金人民币 _________元整，甲方在收到保证金后予以书面签收。

六、 甲方义务 obligations of party a
1. 甲方须按时将房屋及附属设施（详见附件）交付乙方使用。
party a will provide the premises and attached facilities （see the appendix of furniture list for detail） on schedule to party b for using.
2. 房屋设施如因质量原因、自然损耗或灾害而受到损坏，甲方有修缮并承担相关费用的责任。
in case the premise and attached facilities are damaged by quality problems， natural damages or disasters， party a will be responsible to repair and pay the relevant expenses.
3. 甲方应确保出租的房屋享有出租的权利，反之如乙方权益因此遭受损害，甲方应负赔偿责任。
party a will guarantee the lease right of the premises. otherwise， party a will be responsible to compensate party b's losses.
七、 乙方义务 obligations of party b
1. 乙方应按合同的规定按时支付定金、租金及保证金。
party b will pay the rental， the deposit and other expenses on time.
2. 乙方经甲方同意，可在房屋内添置设备。租赁期满后，乙方将添置的设备搬走，并保证不影响房屋的完好及正常使用。
party b may decorate the premises and add new facilities with party a's approval. when this contract expires， party b may take away the added facilities which are removable without changing the good conditions of the premises for normal use.
3. 未经甲方同意，乙方不得将承租的房屋转租或分租，并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损，乙方应承担赔偿责任。
party b will not transfer the lease of the premises or sublet it without party a's approval and should take good care of the premises. otherwise， party b will be responsible to compensate any damages of the premises and attached facilities caused by its fault and negligence.
4. 乙方应按本合同规定合法使用该房屋，不得擅自改变使用性质。乙方不得在该房屋内存放危险物品。否则，如该房屋及附属设施因此受损，乙方应承担全部责任。
party b will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. otherwise， party b will be responsible for the damages caused by it
5. 乙方应承担租赁期内的水、电、煤气、电讯、收视费、等一切因实际使用而产生的费用，并按单如期缴纳。
party b will bear the cost of utilities such as communications， water， electricity， gas， management fee etc. on time during the lease term.
八、 合同终止及解除的规定 termination and dissolution of the contract
1. 乙方在租赁期满后如需退租或续租，应提前两个月通知甲方，由双方另行协商退租或续租事宜。在同等条件下乙方享有优先续租权。
within two months before the contract expires， party b will notify party a if it intends to extend the leasehold. in this situation， two parties will discuss matters over the extension.
2. 租赁期满后，乙方应在当天将房屋交还甲方；任何滞留物，如未取得甲方谅解，均视为放弃，任凭甲方处置，乙方决无异议。
when the lease term expires， party b will return the premises and attached facilities to party a within days. any belongings left in it without party a's previous understanding will be deemed to be abandoned by party b. in this situation， party a has the right to dispose of it and party a will raise no objection.
3. 本合同一经双方签字后立即生效；未经双方同意，不得任意终止，如有未尽事宜，甲、乙双方可另行协商。

九、 违约及处理 breach of the contract
1. 甲、乙双方任何一方在未征得对方谅解的情况下，不履行本合同规定条款，导致本合同中途中止，则视为该方违约，双方同意违约金为人民币___________元整，若违约金不足弥补无过错方之损失，则违约方还需就不足部分支付赔偿金。

上海市房屋租赁一、本合同适用于本市行政区域范围内的商品房预租以及按市场化原则协商确定租金的房屋租赁，不包括按市政府规定的租金标准出租的公有居住房屋、行政调配方式出租和政府投资建造的公益性的非居住房屋以及在《条例》施行前按照市政府规定的租金标准出租的私有居住房屋的租赁。
二、预租仅限于房地产开发企业投资建造，并已取得预售许可证的商品房，但房地产开发企业已经预售的商品房不得预租。
三、本合同条款中的［出租］或［预租］为提示性符号，表示该条款适用于出租行为或预租行为。本合同作为房屋租赁合同使用时，只能采用标有［出租］部分的内容；而作为商品房预租合同使用时，则［预租］部分的条款和补充条款中的“预租有关事宜”部分的条款。其他未标有［ ］符号的条款作为通用性条款，不论预租或出租都适用。
四、本合同用于商品房预租的，在该商品房竣工，房地产开发企业办理了房地产初始登记、取得了房地产权征后，预租双方当事人应当签订商品房使用交接书。商品房使用交接书生效后该合同内的原预租条款履行完毕。
五、本合同文本系市房地资源局和上海市工商管理局根据《上海市房屋租赁条例》制定的示范文本（试行）。其合同条款均为提示性条款，供租赁双方当事人约定采用。本合同中的示尽事宜可由甲、乙双方协商一致后，订立补充条款予以明确。
六、本合同签订前，出租人应向承租人出具房地产权证或其他权属证明，房地产开发企业向预租人出具预售许可证。并相互交验有关身份证明。其中将房屋出租给外来流动人员的，出租人还应出示公安部门发放的《房屋租赁治安许可证》。
七、本合同签订后的15日内当事人应按规定办理合同登记备案。其中，属房屋租赁的，应向房屋所在地的房地产交易中心或农场系统受理处办理，领取租赁合同登记备案证明；属于商品房预租的，外销商品房应向市房地产交易中心办理登记备案；内销商品房向房屋所在地的房地产交易中心办理登记备案。预租商品房竣工取得房地产权证，由双方当事人订立预租商品房使用交接书后，再按规定向房屋所在地的房地产交易中心或农场系统受理处办理登记备案，租赁合同登记备案证明。租赁合同经登记备案扣，当发生重复预租、出租、租赁期间房屋转让或设定抵押后被处分等事实时，可以对抗第三人。
八、凡当事人一方要求登记备案，而另一方不予配合的，要求登记备案的一方可持本合同、有效身份证明等有关文件办理登记备案。
九、房屋租赁保证金是一种履约保证的措施。房屋出租时，出租人可以与承租人在合同中约定收取房屋租赁保证金。租赁保证金的数额由租赁双方当事人约定。租赁关系终止时，房屋租赁保证金除用以抵充合同约定由承租人承担的费用外，剩余部分应当归还承租人。
十、本合同文本可向市或房屋所在地区、县房地产交易中心或农场系统受理处购取。双方当事人使用本合同前应仔细阅读，认真了解各条款内容。
十一、本合同为示范文本，供当事人参照使用。
十二、本合同的租赁关系由经纪机构代理或居间的，则租赁当事人应当要求经纪机构和经纪人在本合同的最后页签字、盖章。

一、出租或预租房屋情况

1－3 该房屋的公用或合用部位的使用范围、条件的要求；现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜，由甲、乙双方分别在本合同附件（二）、（三）中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。
二、租赁用途
2－1 乙方向甲方承诺，租赁该房屋作为＿＿＿＿使用，并遵守国家和本市有关房屋使用和物业管理的规定。
2－2 乙方保证，在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前，不擅自改变上款约定的使用用途。
三、交付日期和租赁期限

四、租金、支付方式和期限

五、保证金和其他费用

甲方收取保证金后应向乙方开具收款凭证。

5－2 租赁期间，使用该房屋所发生的水、电、煤气、通讯、设备、物业管理、＿＿＿＿等费用由＿＿＿（甲方/乙方）承担。

六、房屋使用要求和维修责任
6－1 租赁期间，乙方发现该房屋及其附属设施有损坏或故障时，应及时通知甲方修复；甲方应在接到乙方可代为维修，费用由甲方承担。
6－2 租赁期间，乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不合理使用，致使该房屋及其附属设施损坏发生故障的，乙方应负责维修。乙方拒不维修，甲方可代为维修，费用由乙方承担。
6－3 租赁期间，甲方保证该房屋及其附属设施处于正常的可使用和安全的状态。甲方对该房屋进行检查、养护，应提前＿＿＿日通知乙方。检查养护时，乙方应予以配合。甲方应减少对乙方使用该房屋的影响。
6－4 除本合同附件（三）外，乙方另需装修或者增设附属设施和设备的，应事先征得甲方的书面同意，按规定须向有关部门批准后，方可进行。乙方增设的附属设施和设备归属及其维修责任由甲、乙双方另行书面约定。
七、房屋返还时的状态
7－1 除甲方同意乙方续租外，乙方应在本合同的租期届满后的＿＿日内返还该房屋，未经甲方同意逾期返还房屋的，每逾期一日，乙方应按＿＿＿元/平方米（＿＿币）向甲方支付该房屋占用期间的使用费。
7－2 乙方返还该房屋应当符合正常合用后的状态。返还时，应经甲验收认可，并相互结清各自应当承担的费用。
八、转租、转让和交换
8－1 除甲方已在本合同补充条款中同意乙方转租外，乙方在租赁期内，需事先征得甲方的书面同意，方可将该房屋部分或全部转租给他人。但同一间居住房屋，不得分割转租。
8－2 乙方转租该房屋，应按规定与接受转租方订立书面的转租合同。并按规定向该房屋所在区、县房地产交易中心或农场系统受理处办理登记备案。
8－3 在租赁期内，乙方将该房屋转让给他人承租或与他人承租的房屋进行交换，必须事先省得甲方书面同意。转让或交换后，该房屋承租权的受让人或交换人应与甲方签订租赁主体变更合同并继续履行本合同。 8-4 在租赁期内，甲方如需出售该房屋，应提前三个月通知乙方。乙方在同等条件下有优先购买权。
九、解除本合同的条件
9-1 甲、乙双方同意在租赁期内，有下列情形之一的，本合同终止，双方互不承担责任：
（一）该房屋占用范围内的土地使用权依法提前收回的；
（二）该房屋因社会公共利益或城市建设需要被依法征用的；
（三）该房屋毁损、灭失或者被鉴定为危险房屋的；
（四）甲方已告知乙方该房屋出租前已设定抵押，现被处分的。
9-2 甲、乙双方同意，有下列情形之一的，一方可书面通知另一方解除本合同。违反合同的一方，应向另一方按月租金的____倍支付违约金；给对方造成损失的，支付的违约金不足抵付一方损失的，还应赔偿造成的损失与违约金的差额部分：
（一）甲方未按时交付该房屋，经乙方催告后___日内仍未交付的；
（二）甲方交付的该房屋不符合本合同的约定，致使不能实现租赁目的的；或甲方交付的房屋存在缺陷，危及乙方安全的。
（三）乙方未征得甲方书面同意改变房屋用途，致使房屋损坏的；
（四）因乙方原因造成房屋主体结构损坏的；
（五）乙方擅自转租该房屋、装染该房屋承租权或与他人交换各自承租的房屋的；
（六）乙方逾期不支付租金累计超过____月的；

十、违约责任
10-1 该房屋交付时存在缺陷的，甲方应自交付之日起____日内修复，逾期不修复的，甲方同意减少租金变更有关租金条款。
10-2 因甲方未在本合同中告知乙方，该房屋出租前已抵押或产权转移已受限制，早成乙方损失的，甲方应负责赔偿。
10-3 租赁期间，甲方不及时路性本合同约定的维修、养护责任，致使房屋损坏，造成乙方财产损失或人身伤害的，甲方承担赔偿责任。
10-4 租赁期间，非本合同规定的情况甲方擅自解除本合同，提前收回该房屋的，甲方应按提前收回天数的租金的______倍向乙方支付违约金。若支付的违约金不足抵付乙方损失的，甲方还应负责赔偿。
10-5 乙方未征得甲方书面同意或者超出甲方书面同意的范围和要求装修房屋或者增设附属设施的，甲方可以要求乙方________________（恢复房屋原状/赔偿损失）
10-6 租赁期间，非本合同规定的情况，乙方中途擅自退租的，甲方可没收乙方的保证金，保证金不足甲方损失的，乙方还应负责赔偿。
十一、其他条款
11-1 租赁期间，甲方需抵押该房屋，应当书面告知乙方，并向乙方承诺该房屋抵押后当事人协议以折价、变卖方式处分该房屋前___日书面征询乙方购买该房屋的意见。
11-2 甲、乙双方约定本合同签署后的15日内，应有甲方负责按规定向房屋所在地区、县房地产交易中心或农场系统受理处办理登记备案，领取房屋租赁登记备案证明；本合同经登记备案后，凡变更、终止本合同的，由______（甲方/乙方）负责在本合同变更终止之日起的15日内，向原登记机构办理变更、终止登记备案手续。因甲方未办理房屋租赁登记备案或变更的，所引起的法律纠纷，由甲方承担一起责任。 本合同自_________（签字/登记备案）生效。
11-3 本合同未尽事宜，经甲、以双方协商一致，可订立补充条款。本合同补充条款及附件均为本合同不可分割的一部分，本合同及其补充条款和附件内空格部分填写的文字与铅印文字具有同等效力。
11-4 甲、以双方在签署本和同时，对各自的权利、义务、责任清楚明白，并愿按合同规定严格执行。如一方违反本合同，另一方有权按本合同规定索赔。
11-5 甲、以双方就履行本合同发生纠纷，应通过协商解决；协商解决不成的，可选择下列一种方式解决（下列两种方式由甲、以双方共同任选一种）：
（一）、提交 ___________仲裁委员会仲裁；
（二）、依法向人民法院起诉。

补充条款
一、预租有关事宜
1-1 甲乙双方约定，甲方于本合同生效之日向乙方一次性收取_____（币）元（折合人民币____ 元）预收款。预收款的使用有甲、乙双方当事人在补充条款中另行约定。
1-2 甲方预租的商品房必须办理了房地产初始登记手续，取得新建商品房的房地产权证后方可交付；

1-4 该租赁房屋实际建筑面积在房屋竣工后，以上海市房屋土地资源管理局认定的测绘机构的实测建筑面积为准。
